Terms of Service

These Terms of Service (the "Terms") govern your access to and use of MailVerify, the business email verification service available at businessemailverification.com (the "Service"), operated by [Legal entity, TODO] ("we", "us" or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Service description

MailVerify checks email addresses you submit and returns deliverability signals. Checks may include syntax and format validation, MX and domain checks, SMTP mailbox verification, and detection of disposable, role-based and catch-all addresses. You can verify a single address or upload a list for bulk verification. The Service returns results so you can clean your lists before you send.

2. Acceptable use

You are responsible for the email addresses you submit and how you use the results. By using the Service you represent and warrant that:

• you have a lawful basis to process every address you upload, including any consent or legitimate interest required under applicable law;
• you will not use the Service, or any results from it, to send spam, conduct harassment, commit fraud, or carry out any unlawful or abusive activity;
• you will not attempt to use the Service to harvest, validate or enrich addresses you have no right to contact;
• you will not resell, sublicense or attempt to reverse engineer the Service, or use it to build a competing product;
• you will not overload, probe, or interfere with the Service or attempt to bypass any rate limits or access controls.

We may suspend or terminate access if we reasonably believe these Terms have been breached.

3. No warranty on deliverability predictions

Email verification is a best-effort prediction, not a guarantee. Mail servers behave inconsistently, catch-all domains accept everything, and the status of a mailbox can change at any time. The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that any result is correct, that any address is deliverable, or that the Service will be uninterrupted or error-free.

4. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data, goodwill, sender reputation, or deliverability, arising out of or related to your use of the Service. Our total aggregate liability for any claim relating to the Service will not exceed the greater of the amount you paid us for the Service in the three months before the claim, or one hundred US dollars.

5. Plans, free tier and payment

The Service offers a free tier with usage limits and one or more paid plans with higher limits and additional features. Paid plans are billed in advance on the cycle described at checkout. Fees are non-refundable except where required by law. We may change plan pricing or limits with reasonable notice; changes do not apply retroactively to a billing period you have already paid for.

6. Data processing and privacy

When you upload a list, you remain the controller of that personal data and we act as your processor. Our handling of the addresses you submit, including retention and deletion, is described in our Privacy Policy, which forms part of these Terms.

7. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Material changes will be communicated where practical. Your continued use of the Service after changes take effect means you accept the updated Terms.

8. Governing law

These Terms are governed by the laws of [Governing law jurisdiction, TODO], without regard to its conflict of laws rules. The courts located in that jurisdiction will have exclusive jurisdiction over any dispute arising from these Terms or the Service.
